John Roberts serves as the chief justice of the United States Supreme Court, which has twelve members (three are deceased). The Constitution’s Articles I and III provide the Supreme Court with its legal authority. Additionally, the constitution stipulates that its judicial authority encompasses all disputes arising under the constitution, federal laws, or signed international treaties, whether they be in equity or the law. Trump v. International Refugee Assistance Project was one of the cases the court decided on, and it is a case worth paying attention to.
The court decided to maintain the injunction in the case of respondents who contested Executive Order No. 13780, “Protecting the Nation from Foreign Terrorist Entry into the United States.” However, Justice Thomas and Justice Alito, and Justice Gorsuch concurred in part and dissented in part with the court’s judgment. The dissent regards the balance of equities; does it lie with the government or respondents (Trump. v. International Refugee Assistance Project 15). I was surprised at the decision of upholding the executive orders. I believe it is not right to ban a person from traveling into the U.S because they belong to a specific Muslim country. The whole travel ban case is controversial travel ban, and I expect future battles over Supreme Court’s judgment.
Another case is California Public Employees’ Retirement System V. Anz Securities, Inc., where the majority opinion dismissed the filling by the public pension fund on the basis that it was made more than three years after the offering of the securities. However, Justices Ginsburg, Sotomayor and Kagan gave a dissenting opinion. I was surprised at the majority decision because meeting the timelines required for a class action as required by the Securities Exchange Act of 1933 is shows inconsistency with Rule 23 (class actions). Also, the ruling does not cater for the interests of the public who had investments in the California public system, and it would encourage defendants to slow down proceedings to let three years expire (Bradford)
