The government of the United States comprises of three branches; the legislature, Executive, and the Judiciary, each mandated to perform different tasks. The judiciary is composed of the court systems, with Supreme Court as the uppermost court in the land. The Supreme Court is often respected worldwide due to its superiority, the liberation of its judges and its role in delivering just and fair justice (Francis, 2008). Thus, this paper has detailed information pertaining the position of Supreme Court in checking and constraining the rest of the branches of Government.
Firstly, the Supreme Court interprets laws and ensures that it is constitutional. Typically, the Supreme Court’s ruling on the constitution is mostly final (Leiter, 2015). Thus, this means that the Executive and the Legislature have no powers whatsoever to alter the decisions of the Supreme Court. Similarly, the Supreme Court has the authorities to invalidate the legislative or even the executive actions whenever they deem unconstitutional, thus ensuring that each branch performs roles constitutionally mandated to them only.
Secondly, the Supreme Court is involved in making verdicts concerning the constitution and even State conflicts. Typically, this is one of the primary roles that the Supreme court is always mandated to play. Although the legislature and executive can amend laws to reverse the Supreme Court’s decision, their actions only end up strengthening the Supreme Courts roles in interpreting the constitution (Leiter, 2015). Similarly, the conflicts that may exist between States can just be sorted out by the Supreme Court whose decision will be considered final.
In essence, of the three branches of government, the judiciary appears to play more significant roles. The Supreme Court, in particular, plays a massive role in ensuring that every arm of government and the citizens behaves themselves constitutionally.
