The Classifications of Offenses

The classifications of offenses used in the majority of states include misdemeanors and felonies, which come before lesser infractions. If the offense carries a penalty of higher fines and occasionally even a sentence of imprisonment lasting no longer than a year, it is classified as a misdemeanor. The majority of minor convictions result in sentences that must be served in local or regional jails, and these cases are typically decided after shorter trials. On the other hand, felonies are the most serious types of offenses that fall within the classification of a degree. Indicting someone with a crime is the prosecutor’s choice and the requirement of most states is that he or she has to get an indictment from grand adjudicators. Moreover, the court always provides the accused with an attorney if they are not in a position to afford one, and if convicted, they usually serve their terms in the federal correctional organizations (HG.org, 2017).

Tort Law

A tort law is an organization of rights, compulsions, and resolutions that are applicable by the courts in the public proceedings for the provision of relief for the individuals harmed by the others’ wrongful conducts. In a tort lawsuit, there are various types of damages, and the first one is the compensatory damages which are inclusive of the pain and misery, lost remuneration and other health bills sustained by the petitioner. The second one is the nominal damages which are very negligible, and their awards are only if an individual proves his or her case but doesn’t show any injury. There are also punitive damages which have the intention of punishing the offenders not to repeat their actions in the future. In the business environment, the examples of tort damages are the disparagement which takes place when a company makes inaccurate statements regarding the quality of products and the unfair competition which involves the infringement of the trademark and copyright (LaMance, 2017).

Wrongful Interference

The wrongful interference with a business relationship is whereby the defendant deliberately and unfairly meddles with the legal production welfare of their partner. The advantages of the unlawful interference are that there is usually no liability if in case there was permission for the interference. Moreover, it often leads to the efficient marketing of the company products. On the other hand, the disadvantage of the wrongful interference is that it leads to the defamation of the business thus lowering the credit ratings.

Intellectual Property

Intellectual property is the branch of regulation dealing with the protection of the rights of individuals who have created the unique works. There are three kinds of intellectual property; the patents, copyrights, and trademarks. The patents offer protection to an innovation so as not to undergo sales, usage, or creation by others for a given period. The copyrights defend the classy arts thus offering the limited rights to the owners to duplicate more of their work. The last type of intellectual property is the trademarks, and they shield the names and the identification marks of the companies and their goods. The marks give the consumers the easier time when it comes to the differentiation of the business competitors (ALL LAW, 2017).
