A University Professor’s Complaint

A university professor who disagreed with official university regulations that allowed for intense competition amongst universities over personnel poaching filed the complaint. This is mostly because the University of Southern California seized the chance to conduct an Alzheimer’s disease-focused research initiative when it was offered (CSU-Global Library, 2015) Researchers from the University of California, San Diego, have devised and launched this study project. About 70 people were hired away from University of California at University of Southern California as a result of this bold move (CSU-Global Library, 2015). Additionally, it sparked irate recrimination from UC San Diego staff, which led to a lawsuit. However, instead of outbidding each other, the two University institutions developed a friendly detente that saw both of them agreeing to a general ban. This is in regards to forcefully hiring faculty members from other Universities, instead of trying to outwit each other in issues such as scientific talent (CSU-Global Library, 2015).

Discussion

No single business or institution would want to see its top talented employee snatched away by its rivals. This is mainly because first, they will be forced to spend much considerable time to find new employees who have the capacity of replacing such talent in a very tight labor market (Hill & Hult, 2017). Moreover, the process of replacing top talented employees has been established to be extremely expensive and challenging. However, business and institutional management are more likely to deal with such issues as a result of globalization, poor leadership development practices, as well as demographic trends within institutions and firms. In essence, the war regarding talent is more likely going to intensify, and businesses will be faced with more tough times ahead. Nevertheless, it is important to note that there are strategies that may be adopted by firms or institutions when they discover that they are about to lose talented employees to their rivals and thus minimize the probabilities of incurring losses (Hill & Hult, 2017).

Non-solicitation and Non-compete Agreements

Non-solicitation agreements, as well as non-compete agreements, have long been adopted and used as standards for tools that kept employees from leaving their current companies and also kept poaching at bay (Hill & Hult, 2017). However, it is worth noting that all legal agreements regarding this matter are never enough, despite the fact that they are essential. Also, in spite of changing times, legislation created against non-compete is also stifling performance, according to research studies (Porter, 2014). Today, a growing body of research is suggesting that when employees end up developing harsh restrictions against employees, it indicates that employers owning employees are more likely going to damage the reputation and brand of the companies (Porter, 2014). This is mainly because employees have a reservation and right of determining their career objectives and goals.

Personal Evaluation

In this regard, I do not agree with the outcome of the above case study because the seventy employees were neither coerced nor forced to decide between leaving their former employer by the University of Southern California. This essentially means that such non-compete contracts or agreements shouldn’t be relied upon by employees regarding making decisions about their future income (Porter, 2014). Instead, employers should adopt favorable leadership practices that will force their employees to be loyal due to satisfaction. Further research indicates that generally, employees are more receptive towards their employers. This means that they are more likely to quit their jobs during their employment anniversary dates when they feel that they are not motivated in their current work.
